道路交通事故论文:道路交通事故责任主体的认定【中文摘要】道路交通事故人身损害赔偿纠纷案件已成为当前各 基层法院民商事案件中的主要案件类型之一在司法实践中,正确认 定道路交通事故责任主体对处理此类纠纷有着极为重要的理论及实 践意义鉴于司法实践中对交通事故责任主体的认定面临的诸多困境, 在《侵权责任法》中,就专章立法对机动车交通事故责任主体进行了 较为详细的规定,使得上述问题得到了很大程度上的统一,在审判实 务中具有重要的现实意义但是由于立法的局限性和现实生活的复杂 多样性,虽然《侵权责任法》在一定程度上改变了我国原有的《民事 诉讼法》及《道路交通安全法》,等法律法规过于粗略的问题,但仍然 存在诸多不足本文除了引言外,主要包括案情介绍、案件焦点与分 歧意见、研究结论三个部分引言部分:主要说明研究道路交通事故 责任主体认定的实践意义第一部分:案情介绍主要是介绍一起道 路交通事故案件的案情包括法院对案件事实的认定、原告的诉称、 被告的辩称及法院的裁判结果第二部分:案件焦点与分歧意见包 括法院对案件焦点的归纳和双方当事人对案件的分歧意见第三部 分:研究结论此部分为论文的核心主要涉及以下六个方面的内容: 1、银色轿车与张华驾驶的货车之间的法律关系认定:通过对共同侵 权、共同危险行为和无意思联络的数人侵权之间的分析比较,最终认 定案件中两侵权车之间成立无意思联络的数人侵权。

2、雇员在从事 雇佣活动中发生道路交通事故时责任主体的认定:通过对《侵权责任 法》与《人身损害赔偿解释》中关于雇主责任的分析比较,最终认定 雇员张华无须对在从事雇佣活动过程中致人损害的后果承担赔偿责 任,应由雇主李飞对外承担全部赔偿责任3、挂靠机动车发生道路交 通事故时责任主体的认定:鉴于当前理论和实务中对挂靠机动车发生 交通事故时责任主体认定上存在的争议较大,加之《侵权责任法》对 此也未作出明确规定,本文从挂靠业务的性质和出发,最终认定挂靠 单位应当对挂靠机动车发生交通事故时致人损害的后果承担连带责 任4、保险公司在道路交通事故人身损害赔偿纠纷案件中诉讼地位 的认定:通过对相关法律法规的分析比较,最终认定保险公司可以以 承保机动车交通事故责任强制保险(以下简称交强险)为由在道路交 通事故人身损害赔偿纠纷中作为被告进入诉讼,不能以承保商业第三 者责任保险为由在道路交通事故人身损害赔偿纠纷中作为被告进入 诉讼5、机动车驾驶员肇事后逃逸时对受害人的救济:通过目前对 驾驶员肇事后逃逸时对受害人权益维护上存在的制度缺失,提出应当 尽快建立和完善机动车社会救助基金制度和其他社会保障机制6、 对案件的处理意见:结合对上述问题的探讨分析,就本案的处理上提 出自己的看法。

英文摘要】Nowadays, the cases of compensation for damage oftrafficaccidentshavebecomeoneofthemainlytypeofcivil cases in the basic people's courts. In judical practice, tortfeasors could be properly and effectively affirmed in traffic accidents has important significance both theoretically and practically to deal with this sort of cases. Due to the responsibility affirmation in traffic accident has involved in dilemmas in judical practice so that Tort Law of the People's Republic of China proposes much more specific rules and provisions to handle these issues and creates practical significance in the process of trial practice issues. However, although Tort Law of the Peopl'e s Republic of China has offset some shortages of Law of Civil Procedure and The traffic Safety Law ofPRC to some extent, it still leaves much to be improved on the basis of the limitation of law and the rich diversity of life. This paper includes four dimensions:introduction, the background of the case, case central point and different opinions, and a conclusion. I A introduction of the practical significance of responsibility affirmation in traffic accident. IIDescribing the background of a traffic accident, which including affirmation of the case, prosecutor'sallegationandrespondent'sallegation,aswell the juridical result of the court. IIlFocusing on the summary and conclusion of case central point from the court and the disagreement between both parties.WThe fourth dimension is the core of the paper and consists of six parts.a. The identificationofcivillegal relationship between the silver car and Zhang Hua's lorry:It is affirmed that the case belongs to the number of people without meaning contact for infringement through the analysis and comparison of contributory infringement, joint dangerous behavior and the number of people without meaning contact for infringement.b. The identification of the tortfeasor when the employer involves in the traffic accident in the process of employment. It is affirmed that Li Fei(employer) should take all of responsibilities of the case rather than Zhang Hua(employee) through analyzing the employer's responsibilities on the basis of Tort Law of the People's Republic of China and Compensation for Personal Injury explanation.c. The identification of the tortfeasor when the join-operated vehicle involves in the traffic accident:Owing to there s a great debate about the responsibility affirmation of the join-operated vehicle in traffic accident in the theory and practice, and there is no clear and specific rules and provisions in Tort Law of the People's Republic of China, so that the paper affirms that the organization hung rely on by the join-operated lorry shall bear joint liabilities from the perspectives of quality and purpose.d. The identification of the proceeding position of the insurance company in the case concerning personal damage compensation with traffic accidents. It is certified that the insurance company can be regarded as the respondent based on the motor vehicle traffic accident responsibility compulsory insurance instead of business insurance through analyzing relevant law rules.e. Taking immediate measures to offer help to victims after the hit-and-run driver escape. It is necessary to consummate social assistance funds for road traffic accident function and motion pattern and other live insurance systems for lack of safeguarding the right of victims.f.
